1.1.The builder has bought the land on the auction organized to sell the land or the right for signing leasing contract concerning the land owned by the state or municipality(further – auction)

UDPL is the basis for the preparation of project documentation, obtaining building permits and for obtaining a permission to put the object into operation
Since the land for construction is provided at the end of the auction, in respect of such land the state cadastral registration is already held, the allowed use of the land is determined, based on the results of the engineering survey of parameters of permitted construction of capital object and the technical connection conditions of the object to the grid of engineering support and connection fees - all this information must be indicated in UDPL

PART 2. PREPARATION OF PROJECT DOCUMENTATION

Getting an expert opinion of project documentation and (or) engineering research (if such examination is provided by the Town-planning Code of the RF)

Conclusion of the examination of project documentation and (or) engineering research results
Certifies conformance (positive conclusion) or non-conformance (negative conclusion) of project documentation to requirements of technical regulations and engineering survey results, requirements for the content of sections of project documentation provided by the Town-Planning Code of the Russian Federation, as well as on conformance of results of engineering studies with technical regulations (in case the results of engineering surveys were sent to the State examination at the same time with design documentation), conformance (positive conclusion) or non-conformance (negative conclusion) of engineering research results with the requirements of technical regulations (in case the results of engineering surveys have been sent for examination before sending the project documentation for examination). It is necessary for obtaining a building permit.
Autonomous establishment "Departmnet of State Examination" or a legal entity accredited for the right to non-state examination of the relevant type (by choice of the applicant, except in cases where, in accordance with the Town-Planning Code of the Russian Federation, in respect of design documentation for capital construction objects and engineering research results carried out for the preparation of such project documentation, state examination is provided)
1) application for the examination, which shall include: identifying information about work performers - the people who carried out the preparation of project documentation and performed engineering surveys (surname, first name, patronymic, details of ID documents, the postal address of the place of residence of an individual entrepreneur, the full name and location of a legal entity); identifying information about the object of capital construction, project documentation and (or) the results of engineering surveys (name of object(s) of the proposed construction, postal (construction) address of the object(s) of capital construction, basic technical and economic characteristics of the object(s) of capital construction (area, volume, length, number of floors, capacity, etc.); identifying information about the applicant (name, surname, patronymic, details of ID documents, postal address of the place of residence of the developer (customer) - a private person, full name of a legal entity, location of the developer - a legal entity, and if the developer (customer) and the applicant are not the same person - mentioned information about the applicant too);
2) project documentation for the object of capital construction in accordance with the requirements (among them there are requirements to the structure and content of the documentation section) of the Government of the Russian Federation;

3) a copy of design specifications;

4) the results of engineering surveys in accordance with the requirements (including the requirements to the composition of these results) of the Government of the Russian Federation;

5) a copy of the assignment for performing of engineering research;

6) documents confirming the authority of the applicant to act on behalf of the developer, the customer (if the applicant is not the customer and (or) the developer), in which the authority to make, change, execute, terminate the contract on carrying out state expertise should be explicitly stated

45 days in respect of: a) the results of engineering studies that have been sent for examination before sending this project documentation to examination; b) the project documentation or project documentation and engineering survey results in respect of capital construction objects that are non-unique objects;

c) project documentation and project documentation and engineering survey results in relation to capital construction objects, the construction of which will be carried out in special economic zones;

PART 3. BUILDING LICENSING

7 Building licensing Building permit
Confirms compliance of the project documentation with the requirements of urban land development plan or area planning design and boundary-setting plan (in case of construction, reconstruction of linear objects) and gives a developer the right to carry out construction.

1) The application for a building permit;

2) documents of entitlement for the land plot;

2.1) in the presence of transfer agreement in the cases established by the budget legislation of the Russian Federation, the State public authority, the State Atomic Energy Corporation "Rosatom", the governing body of a state budget fund or a local government authority of the state (municipal) customer powers, made under the implementation of public investment – the above agreement, documents for entitlement for the land plot of the owner, with whom the agreement was made;

3) the development plan of the land plot or in the case of issuance of building permits for a linear object, the details of the area planning design and boundary-setting plan;

4) The materials contained in the project documentation:

a) an explanatory note;

b) a land plot layout diagram, executed in accordance with the urban development plan of the land plot, with the indication of the location of a capital construction object, entrances and passages to it, the boundaries of public easement coverage, objects of archaeological heritage;

c) a land plot layout diagram, confirming the location of the linear object within the red lines, which are approved as part of area planning documents with regard to linear objects;

d) schemes depicting architectural solutions;

e) information on the technical equipment, the master plan of utility services with indication of places of linking (technological connection) of the projected capital construction object to engineering and technical support networks;

f) plan of construction organization of the capital construction object;

g) management plan for demolition or dismantling of capital construction objects, and their parts;

5) positive conclusion of examination of design documentation for a capital construction object (for certain stages of construction in the case stipulated by paragraph 12.1 of Article 48 of this Code), if the project documentation is subject to examination in accordance with Article 49 of this Code, positive conclusion of the state examination of project documentation in cases specified in part 3.4 of Article 49 of this Code, positive conclusion of the state ecological expertise of project documentation in the cases specified in paragraph 6 of Article 49 of this Code;

6) permission to deviate from boundary parameters of authorised construction, reconstruction (if the developer has been granted such authorization in accordance with Article 40 of the Town Planning Code of the Russian Federation);

7) the consent of all right holders of the capital construction object in the case of reconstruction of such an object, except as specified in paragraph 6.2 of this part of the case of reconstruction of an apartment building;

7.1) in the case of the reconstruction by the state (municipal) customer being the public authority, the State Atomic Energy Corporation "Rosatom", governing body of the state non-budgetary fund or local authority for the capital construction object of the state (municipal) property, which right holder is the state (municipal) unitary enterprise, state (municipal) budget or autonomous establishment in which respect the mentioned body carries out the respective functions and powers of the founder or the rights of the owner of the property, - agreement on making such a reconstruction, also defining conditions and procedure for damage compensation inflicted to the specified object during the implementation of reconstruction;

7.2) decision of the general meeting of owners of premises in an apartment building, adopted in accordance with housing legislation in the case of reconstruction of an apartment building, or if as a result of such a reconstruction would happen a reduction in the size of the common property in an apartment building, the consent of all owners of premises in an apartment building;

8) a copy of the certificate of accreditation of the legal entity that issued the positive conclusion of the non-state examination of project documentation, if the conclusion of non-state examination of project documentation is presented.
